Estate Sales
So who picks the real estate agent when an estate has property or a house that needs to be sold? It's up to the executor. If there is no executor, then the court will have to appoint someone, which could end up being anyone in the deceased family. You could find yourself being the executor where you are ultimately responsible for the sale of the property and home which also includes ensuring that the beneficiaries satisfied with your decisions. This can be a lot of pressure. If you are a co-executor, you may find yourself working with someone you don't' know or someone you do not see eye to eye with. This can go on for over a year and sometimes longer. Perhaps you are only a beneficiary and are reliant upon the executor to sell the home or property for fair market value?
This leaves you wondering if the executor will cave to pressure to wrap up the estate quickly. Maybe there is a connection between the executor and other beneficiaries that leaves you doubting that the decision to sell for a specific amount is a good one. Maybe some beneficiaries want to hold out, remember there is no set time limit by which you must sell the property, as long as the beneficiaries are ok with it and you're prepared to deal with the things like property tax, maintenance, insurance, capital gains tax, annual tax returns etc. This may be what the majority of beneficiaries want and agree to, but then again maybe you don't agree to that.
Whether you are a beneficiary or executor, you will need a meeting of the minds on all beneficiary's expectations on the valuation of any property or home which isn't always easy when there are lots of beneficiaries all with different ideas, goals and interests.
